TERMS & CONDITIONS

As a registered member of LURA Lifestyle Ltd (“Member”), you agree to abide by these terms and conditions, and when ordering, or purchasing anything from a supplier of products or services (a "Supplier") you agree that these terms and conditions shall apply to your order. These terms and conditions shall prevail over any other terms and conditions in any form whatsoever.

 

1. DEFINITIONS

1.1 Benefits: the benefit made available to members by partners sourced through LURA Lifestyle – the member is under no obligation to use the benefits and has the option to choose an alternative.

1.2 Booking Fee: the fee associated to bookings made on behalf of the member, this fee is only charged to the allocated card upon approval from the member.

1.3 Member: the person registered to LURA Lifestyle. As an exclusive membership LURA Lifestyle reserves the right to decline any new member application and or annual renewal of an existing member.

1.4 Membership Fee: the annual fee for membership, this varies dependent on the selected membership tier.

1.5 Membership Tier: Sapphire and Diamond – the different tiers are associated to a different service solution.

1.6 Payment Card: card details supplied by the member to LURA Lifestyle for the payment of membership fees, booking fees, payment for products and services, securing of hotels and restaurant bookings, and so on. This card is either an approved debit card or credit card. LURA Lifestyle reserves the right to request alternative cards at any stage of the membership.

1.7 Request: request placed by a member with LURA Lifestyle.

1.8 Services: the booking service provided by LURA Lifestyle to its members as part of their value proposition and membership.

1.9 Partner: the partner is a supplier and or vendor engaged by LURA Lifestyle on behalf of and as an agent for a member to provide goods and/or services to that member to fulfil his or her request.

 

2. MEMBERSHIP RULES

2.1 All membership applications are subject to verification and acceptance by LURA Lifestyle at its sole discretion. LURA Lifestyle will notify you in the event that your membership application has been accepted. Should LURA Lifestyle reject an application, there is no obligation to disclose the reasons. All member applications are considered private and are treated with the utmost discretion and confidentiality.

2.2 The onus is upon the applicant to provide accurate and true details when you apply for LURA Lifestyle membership. Failure to do so may invalidate your membership. Your responsibility to provide accurate information is a continuing obligation and you must notify LURA Lifestyle in the event that any information provided by you changes.

2.3 Your membership is personal to you. You allocated card will be charged for benefits and services provided. You as the member are responsible for ensuring that no one uses your membership.

2.4 All reservations made should be for your personal use only. If you wish to appoint somebody to make reservations on your behalf, please provide their information to your LURA Lifestyle Manager.

2.5 Access to and use of the members section of the LURA Lifestyle website ("Site") is via a password and is reserved exclusively for members. You are solely responsible for maintaining the confidentiality of the password and you agree to notify LURA Lifestyle immediately if you believe that there has been any breach of security (e.g. the unauthorised use of your password).

2.6 The LURA Lifestyle membership is only available to person over the age of 18. Any unauthorised or attempted use by person under the age of 18 will be null and void.

 

3. MEMBERSHIP FEES, CANCELLATIONS AND RENEWALS

3.1 Membership fees are communicated upon application.

3.2 You acknowledge that your payment of the membership fee constitutes your express approval and request for LURA Lifestyle to begin to supply you with our benefits and services aligned to your membership tier.

3.3 Your membership fee is non-refundable. However, LURA Lifestyle may at its sole discretion elect to refund your membership fee in whole or in part depending on the circumstances relating to the cancellation of any membership.

3.4 LURA Lifestyle reserves the absolute right to cancel or suspend your membership (at its sole discretion) for any reason whatsoever. If LURA Lifestyle cancels your membership, it shall refund the pro rata balance of the annual membership fee on a time apportionment basis in respect of the unexpired period to which the annual membership fee relates.

3.5 Membership fees are due on acceptance of your membership application and annually thereafter (“Renewal Date”). Membership fees are payable annually only and renewed automatically unless informed otherwise.

3.6 You authorise LURA Lifestyle to deduct renewal membership fees by your nominated payment card. If LURA Lifestyle does not hold your payment details, you will be contacted directly in order to renew your membership.

3.7 Any increase or decrease to the membership fees will be notified to all members in advance of their renewal date.

3.8 Booking fees must be paid in full prior to use of the booking.

3.9 If you do not wish to renew your membership, you must notify us more than 48 hours prior to your renewal date.

3.10 If, during the course of your current membership, you wish to upgrade your membership to a higher tier, the difference in price will be calculated on a pro rata basis. You may only downgrade your membership tier upon renewal.

3.11 LURA Lifestyle may at your request purchase goods or services on your behalf. In the event that we act as a credit agent in this regard, you hereby authorise LURA Lifestyle to deduct the credit sum from your payment card immediately.

 

4. MEMBERSHIP BENEFITS

4.1 As a member of LURA Lifestyle, you are entitled to all of the benefits aligned to your selected membership tier. You will have received these as part of your application process.

4.2 As a registered member of LURA Lifestyle, please note that partners and suppliers of benefits and the benefits themselves are subject to availability and may change from time to time without notice.

4.3 LURA Lifestyle aims to ensure that the benefits remain available at all times and are constantly negotiating new benefits to ensure that you the member can receive maximum benefits of your exclusive membership. If any of the benefits become unavailable, we will do all we can to ensure that prior commitments are honoured to the fullest extent possible but shall not be responsible for any actions of the partners and or suppliers outside of LURA Lifestyle’s actual control.

4.4 Members should always log into the website of LURA Lifestyle or contact their Lifestyle Manager to ensure that they understand all the conditions of any offer.

 

5. USING YOUR MEMBERSHIP

5.1 Only once your application has been approved and payment received are you considered a LURA Lifestyle member. As a member you are entitled to benefits and services.

5.2 All services provided by LURA Lifestyle are handled with discretion and confidentiality. LURA Lifestyle reserves the right to withdraw any of these services and/or to refuse to supply the services requested that are not legal and/or go against the moral ethics of the LURA Lifestyle team.

5.3 If LURA Lifestyle is unable to deal with any request, the Lifestyle Manager will inform you as soon as reasonably practicable.

5.4 Partners and suppliers are responsible for providing you with the services, products and benefits you select. Feedback from our LURA Lifestyle members is encouraged to ensure our partners meet the highest service standards.

5.5 Partners and/or suppliers may impose their own terms and conditions and you are required to comply with these.

5.6 As a LURA Lifestyle member, we require that you store your payment card details with us (LURA Lifestyle has the highest form of data storage protection and is happy to share this information upon request). If the member wishes to use an alternative card when ordering a product or service or accessing a benefit, then the member will be required to provide the payment card details. If you request and authorise LURA Lifestyle to use your payment card in order to pay for products or services, you acknowledge and agree that LURA Lifestyle shall have no liability in respect of or be responsible in any way whatsoever in respect of the use of your payment card provided that LURA Lifestyle acts in accordance with the instructions issued by you in relation thereto. You undertake that all details you provide to us for the purpose of booking, ordering or purchasing products or services are correct, that the payment card you are using is your own and that there are sufficient funds to cover the cost of the product or the service.

5.7 From time to time the procurement or provision of certain services, products or benefits may incur a LURA Lifestyle handling charge (of which you will be notified) - in these cases you hereby authorise LURA Lifestyle to debit your payment card with any such handling charges.

5.8 When ordering or booking a product or service or accessing a benefit by telephone, it is essential that members inform them that they are a member of LURA Lifestyle and may be asked to provide their membership number and password and/or identification questions.

5.9 Telephone calls to LURA Lifestyle may be monitored or recorded for training and quality control purposes.

5.10 Services will be provided in English.

5.11 You acknowledge that LURA Lifestyle reserves the right to accept commissions upon the supply of products and performance of services by any partner.

5.12 Hotels

• Hotel cancellation policies are in line with those set by the hotels directly.

• Members are responsible for checking hotel and all booking confirmations are correct. LURA Lifestyle is not liable for any errors made.

• Payment is made to the hotel directly on check out unless otherwise specified.

5.13 Restaurants and Clubs

• When you use the restaurant booking service you hereby authorise the use of your payment card for any cancellation policy or deposit which is forfeited as a result of late cancellation. LURA Lifestyle withholds the right to charge cancellation fees for reservations where the restaurant does not charge directly. Terms of all cancellation policies are set out to you by your Lifestyle Manager.

• LURA Lifestyle reserves the right to deny restaurant requests from members if the member repeatedly fails to honour their bookings or continuously violates cancellation policies.

• Admission of members to any club premises is at all times at the sole discretion of the club partner and LURA Lifestyle shall have no liability where a member is refused admission.

5.14 Tickets

• LURA Lifestyle may be able to obtain best or sold out event tickets though an agent partner. Please note that by requesting such tickets you acknowledge and agree to purchase tickets above face value and a service charge may be incurred.

• LURA Lifestyle is not a seller of the tickets and not responsible for fulfilment of the order.

• All such tickets have their own terms and conditions, as do ticket agent partners, likely to include terms which state the sales are final and no refunds shall be issued.

• LURA Lifestyle is not liable to provide refunds.

• In the event of the show being cancelled, refunds will be issued of the face value of the relevant tickets.

• LURA Lifestyle or its ticket agent partner will dispatch your tickets through delivery agents. The Lifestyle Manager will confirm the delivery options and associated costs with the member. Please note that LURA Lifestyle shall not be liable for any failure by delivery agents to deliver your tickets.

 

6. PLACING A REQUEST

6.1 Members may place requests by telephone, mobile, what’s app or email. The onus is on the member to ensure that their Lifestyle Manager is notified of any changes to the provided contact details. All cancellations and amendments need to be done via email.

6.2 LURA Lifestyle will endeavour to respond within 24 hours of the request unless otherwise specified.

6.3 If LURA Lifestyle is unable or not obliged to deal with any request, it will inform the member as soon as reasonably practicable.

6.4 Requests must be made by or on behalf of the registered member only.

6.5 You undertake that all details you provide to us for the purpose of booking, ordering or purchasing products or services are correct, that the payment card you use is your own and that you have sufficient funds to cover the cost of the product or service.

6.6 From time to time, the procurement of certain services, products or benefits may incur a service charge, handling fee, or booking fee. You hereby authorise LURA Lifestyle to debit your payment card in respect of such fees or charges.

6.7 Monthly statements are available upon request. Please contact your Lifestyle Manager who will arrange this for you. LURA Lifestyle will require up to 48 hours to produce the statement.

 

7. SUPPLIERS

7.1 LURA Lifestyle shall communicate with partners and suppliers on your behalf.

7.2 Partners and suppliers have the right to impose their own terms and conditions, binding upon you at the time of order.

 

8. LIABITITY

8.1 LURA Lifestyle warrants to you that LURA Lifestyle shall use its reasonable endeavours to provide the services with reasonable care and skill and, as far as reasonably possible, in accordance with your request and instructions.

8.2 Where LURA Lifestyle supplies you with any goods or services supplied by a third party, then LURA Lifestyle is acting as your agent in sourcing the goods or services.

8.3 LURA Lifestyle will use reasonable care in selecting the partners and suppliers and ensuring the order is placed in accordance with your wishes.

8.4 You the member have the right to select the options presented to you and so are deemed to be responsible for and shall use your own skill and judgment as to the quality, value and suitability of such information and suggestions in relation to deciding whether to enter into any contract for the supply of services or sale of goods.

8.5 Your contract for the purchase of products or services is made with the relevant partner and or supplier only. LURA Lifestyle acts as an agent for the partner and or supplier and, unless expressly provided otherwise, all your rights and remedies are against the partner and or supplier. Nothing in these terms and conditions is designed to give any other person any rights or remedies under the Contracts (Rights of Third Parties) Act 1999.

8.6 Your contract for the purchase of products or services is made with the relevant partner and or supplier only. You agree that any contract entered into by you with any of the partner and or suppliers is an independent contract. LURA Lifestyle hereby disclaims any and all liability for any act or omission of any partner and or supplier or any loss incurred by you as a result of any act or omission of a partner and or supplier. LURA Lifestyle will however do everything it reasonably can to assist you in any dealings you have with the partner and or supplier.

8.7 LURA Lifestyle accepts no liability for any losses or claims arising from any failure to complete a transaction.

8.8 LURA Lifestyle shall not be liable for any loss, cost, expense or damage of any nature whatever (whether direct or indirect) resulting from the provision of the services or your reliance upon the information and suggestions provided by LURA Lifestyle hereunder and the resulting supply of goods and services to you by any third party.

8.9 LURA Lifestyle shall have no liability to you for any loss, damage, costs, expenses or other claims for compensation arising from requests or instructions supplied by you which are incomplete, incorrect, inaccurate or arising from their late arrival or non-arrival, or any other fault of you.

8.10 LURA Lifestyle shall not be liable to you or be deemed to be in breach of these terms and conditions by reason of any delay in performing, or any failure to perform, any of our obligations in relation to the services, if the delay or failure was due to any cause beyond our reasonable control.

8.11 LURA Lifestyle aims to ensure that viruses (or other programmes having adverse effects) do not reside on the Site, but LURA Lifestyle accepts no responsibility in relation to this.

 

9. CHANGES TO MEMBERSHIP RULES

9.1 LURA Lifestyle may change these terms and conditions from time to time and will notify you of any changes in a timely manner. Notification can be either via website, email, post, the newsletter or other personal deliverance service.

9.2 Your continued use of your membership constitutes acceptance of the altered terms and conditions.

 

10. COPYRIGHT

LURA Lifestyle owns or is lawfully entitled to all of the copyright on the website. All other intellectual property rights are reserved. This service is for your personal use only - you may not use it for commercial purposes. You may only download to your personal computer for viewing purposes and print out a number of pages of this website for your personal use. You may not modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer or sell any information obtained from LURA Lifestyle directly or from the website.

 

11. LINKS

LURA Lifestyle assumes no responsibility for the contents of any other websites to which the Site has links and shall not be held responsible or liable for any loss or damages caused or alleged to have been caused by use of or reliance on any content, products or services available on such hyperlinked sites. LURA Lifestyle may not have control of such websites. The inclusion of any hyperlinks to such other websites does not mean that LURA Lifestyle endorses the material on such websites or has any association with the owner thereof.

 

12. APPLICABLE LAW AND JURISDICTION

12.1 These terms and conditions and your membership with LURA Lifestyle are governed by the laws of England and Wales and are subject to the exclusive jurisdiction of the courts of England and Wales.

12.2 The provisions of the "Privacy Promise" shall apply at all times.
